1. Applicability / Application Area
Solely the general business and payment conditions as formulated at the time an order is placed are applicable to the business relationship between the customer and DE TINKOEPEL TINNEGIETERIJ.
2. Concluding an Agreement
a) The offer by DE TINKOEPEL TINNEGIETERIJ is provided without any obligation. Offers are made subject to the availability of the product. Whenever a product is unexpectedly no longer available, we will contact you to discuss alternatives.
b) A purchase agreement is created once the customer completes an online purchase order form from DE TINKOEPEL TINNEGIETERIJ and sends it to DE TINKOEPEL TINNEGIETERIJ via the internet, by fax or by telephone. Afterwards DE TINKOEPEL TINNEGIETERIJ confirms receipt of the order per e-mail or implicitly by sending the goods.
c) Products can differ from the picture.
3. Price Lists
The prices on our website are in Euros. The price online includes VAT, duties and any other taxes. Shipping costs are stated on the electronic order form. Other exceptions are mentioned in the product-specific information. Therefore, please also read the information with regards to the different shipping methods. Shipping costs and taxes differ per country where the goods are to be delivered. DE TINKOEPEL TINNEGIETERIJ reserves the right to modify the prices and to correct any typing errors. We will contact you if this adversely affects your order. You will then have the right to cancel your order.
4. Payment
The price of the products ordered, including any additional costs are to be paid in full by the customer in advance. You can effect payment by using a bank transfer to our account, by sending a cheque made out to DE TINKOEPEL TINNEGIETERIJ in ILPENDAM in Euros, by credit card or by a direct payment to the postman in the event of a COD shipment. (The latter is only possible within the Netherlands). You can also fax your order and credit card information to DE TINKOEPEL TINNEGIETERIJ. Invoiced deliveries are only possible if this has been explicitly agreed upon by both parties in advance.
5. Delivery
DE TINKOEPEL TINNEGIETERIJ delivers the products ordered after receiving payment of the order amount within the below mentioned delivery times. The delivery times mentioned in these terms, on this website and in the order confirmation serve as an indication and not as an exact delivery date. DE TINKOEPEL TINNEGIETERIJ cannot be held responsible at any time for damages that occur due to exceeding the delivery times. The goods ordered are normally delivered to the customer's address or to a different address as stated in the order within a delivery time that can vary from 2 to 30 business days depending on the chosen shipping method and the location of the delivery address (see also “Information regarding Shipping Methods” on our website).
6. Retention of Title
The goods delivered remain the property of DE TINKOEPEL TINNEGIETERIJ until the customer has paid all outstanding debts to DE TINKOEPEL TINNEGIETERIJ.
7. Warranty against Defects
During the warranty period of 2 months after delivery against defects you are entitled to receive a new shipment to replace the defective goods, whereby DE TINKOEPEL TINNEGIETERIJ is entitled to choose. You are to check the products thoroughly for any defects upon arrival. If any defects are found you are to notify DE TINKOEPEL TINNEGIETERIJ immediately, or at least within 2 months of delivery at the latest. If DE TINKOEPEL TINNEGIETERIJ does not deliver impeccable products within a reasonable period of time, the customer has the right to demand an annulment (cancel the purchase) or a reduction (price discount).
8. Retention, Compensation, Decrease
The customer is only entitled to retention, compensation or reduction if DE TINKOEPEL TINNEGIETERIJ explicitly agreed to this or if the counter claims are legally established, even if the customer reported defects, complaints or counter claims.
9. Liability
DE TINKOEPEL TINNEGIETERIJ is never responsible in the event of severe negligence and intent. This is also applicable to its employees, suppliers and representatives.
10. Data Protection
a) Personal information from the customer, such as the information entered on the order, is only used by DE TINKOEPEL TINNEGIETERIJ in accordance with the existing legal provisions with regards to electronic storage and processing. DE TINKOEPEL TINNEGIETERIJ uses this information solely for processing the order. DE TINKOEPEL TINNEGIETERIJ shall not disclose any personal information to any third party, except for those parties that work with us for handling and delivering the order. We shall make every effort to ensure that these parties do not disclose this personal information to any other third parties. DE TINKOEPEL TINNEGIETERIJ is authorised to use the services of a third party for the purpose of processing your order(s).
b) The customer will receive information from DE TINKOEPEL TINNEGIETERIJ about the information that DE TINKOEPEL TINNEGIETERIJ has in its possession. If you so request, we will produce an overview of this information and send it to you per post. If you wish to examine the registered information, please send a signed request for that purpose, along with a copy of valid identification (passport, driver's licence) to DE TINKOEPEL TINNEGIETERIJ. The customer can withdraw approval for storing this information and end the customer relationship with DE TINKOEPEL TINNEGIETERIJ at any time. DE TINKOEPEL TINNEGIETERIJ will then immediately remove all personal information about the customer in question.
11. Validity
If some of the provisions of this agreement, including these ones are declared null and void, either in part or in whole or if the agreement is defective in any way, the remaining provisions or parts of provisions will remain in force. The prevailing legal regulations will take precedence over the invalid provisions.
